Probably the single most dramatic difference between civil- and common-law procedure is the institution of the civil jury trial, which is now essentially confined to the United States. Providing a trial by jury, however, creates other procedural requirements and pressures. For example, a lay jury can decide the question before it only if all factual matters are presented in a straightforward manner.
